In accordance with DL nº 24/2014, of February 14, and Law nº 94/96, of July 31, by this document, the terms and conditions to be observed in the use of the website www.outversebrand.com, as well as in the process of purchasing the products marketed there, made available to its users.

Thus, users of the site should carefully read the conditions and privacy policy before using it, as by using it or placing an order, users are consenting to be bound by these conditions.

In case of disagreement with these conditions and privacy policy, users should not use the site www.outversebrand.com.

These conditions may be freely changed without prior notice in order to adapt them to the applicable legislation.

1. *INTRODUCTION*
1.1 These Terms and Conditions govern the sale, including registration, of Out’verse products through the website www.outversebrand.com.
1.2 The website www.outversebrad.com is managed by the company Silly Journey Lda., No. 518094073, Estrada Nacional 105, No.247 Covas, Polvoreira (Fábrica Asa, store I.1.9), 4835-164, Guimarães.
1.3 For the purposes of these Terms and Conditions, the following shall be understood:
a) - "OUT'VERSE" - Products marketed on the website www.outversebrand.com;
b) - "User" - Any natural person, non-trader, who places an order through the website www.outversebrand.com;
1.4 The use of the website www.outversebrand.com and the purchase of OUT'VERSE products presuppose the User's knowledge, understanding, and acceptance of these Terms and Conditions.

2. *REGISTRATION ON THE WEBSITE*
2.1 To place an order, the User may previously register by filling in the fields of the form on the website www.outversebrand.com. It is also possible to place an order without prior registration.
2.2 From the moment you access your personal account, the User is subject to these Terms and Conditions.

3. *OUT'VERSE PRODUCTS*
3.1 The website www.outversebrand.com is aimed at all users who wish to purchase Out'verse products from anywhere, 24 hours a day, 7 days a week.
3.2 Information about the characteristics of the products can be found at www.outversebrand.com.
3.3 Out’verse reserves the right to modify, at any time, the information, product offerings, prices, promotions, and commercial conditions presented on the website www.outversebrand.com.

4. *PLACING ORDERS ON THE WEBSITE*
4.1 To order from www.outversebrand.com, the User must have an email account and their browser must be configured to accept cookies and pop-ups, which will allow them to enjoy all the navigability conditions of the Out'verse online store.
4.1.1 The User may proceed with the online purchase of products, for which it is necessary that:
a) Find the product(s) you wish to purchase;
b) Add the selected product(s) to the "Shopping Cart";
c) Register the User's personal data, which will be integrated into the OUT'VERSE database in accordance with the Privacy Policy, including "Delivery Address", "Billing Address", "Payment Method", telephone number, and taxpayer identification number (TIN);
d) Review the order and confirm the request;
4.2 The User will receive an order confirmation email with details regarding the payment method selected.
4.3 Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the respective detailed invoice.
4.4 By submitting the order form, the User accepts the purchase Terms and Conditions described at www.outversebrand.com, as well as the Privacy Policy.
4.5 Out'verse reserves the right not to accept and cancel confirmed orders in the following situations:
a) The product is not available;
b) Payment is not made using any of the payment options available on the website www.outversebrand.com;
c) Payment is not confirmed;
d) Billing information is incorrect or unverifiable;
e) There is an error in the price quotation;
f) It is not possible to deliver to the address provided by the User.

5. *PRICES*
5.1 The prices of the products displayed on the website www.outversebrand.com include Value Added Tax (VAT). The total VAT to be paid by the User will be indicated on the invoice to be sent to the user.
5.2 Prices are all quoted in euros (€). Note that changing the delivery country may affect prices due to different shipping costs. Customs costs for the delivery country of the order will be borne by the customer.
5.3 The prices of the products presented on the website are subject to change. OUT'VERSE reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4 If any errors occur in the price of the requested products, Out'verse or the User may cancel the order until the order is shipped.
5.5 The total price specified at checkout includes shipping costs and taxes from the shipping country.
5.6 The User must pay only the amount specified in the order confirmation.

6. *PAYMENT METHODS*
6.1 The User may make payment for their purchases through the Paypal payment manager and through Multibanco Reference (ATM).
6.2 The User should not attempt to pay by any other means not listed in the specified payment methods. If they do so, we cannot be held responsible for the loss of payment or any other damages that may arise from it.

7. *SHIPPING COSTS*
7.1 Shipments to mainland Portugal have an estimated cost of €6.
7.2 For delivery outside of Europe, all orders will have an associated shipping cost, and may require payment of customs fees, according to the delivery country.

8. *DELIVERY*
8.1 Out'verse dispatches the ordered product(s) from Monday to Friday, from 10 am to 7 pm, excluding holidays, and on the days and hours used by the logistics company, to the delivery address indicated by the User.
8.2 Our delivery service does not include scheduling options, so the delivery of the order will be made without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.
8.3 Delivery times in Portugal vary between 5-10 working days depending on the ordered item. Out'verse's response time within these deadlines varies depending on stock availability, as well as during promotional periods, sales, and Christmas. Each ordered item is created exclusively for that customer.
8.4 OUT'VERSE will inform the User of the unavailability of the ordered product(s), as well as proceed with the refund of the amount paid, within a maximum period of 15 (fifteen) days from the knowledge of the unavailability.
8.5 In case the carrier is unavailable to deliver the products on the indicated date, the User will be contacted to indicate another delivery date.
8.6 Upon delivery, the User must inspect the packaging to check for any damage. If the products are found to be damaged, the User should not accept the delivery of the order, which will be returned. The User should report the situation, if possible documented with photographs, via email to help.outverse@gmail.com, and if agreed, Out'verse will proceed with the re-dispatch of the order, at no cost to the User. If the User wishes to cancel the order, the total amount paid will be refunded.
8.7 If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of the order, please send an email to help.outverse@gmail.com informing us of the situation. After this period, OUT'VERSE cannot be held responsible for the loss of the order.
8.8 Delivery is considered completed with the signature on the delivery receipt at the agreed address.

9. *RIGHT OF WITHDRAWAL*
9.1 The User may withdraw from the contract within 14 (fourteen) days after receiving the order, provided that:
a) The product(s) have not been used;
b) The product(s) maintain their original characteristics and intact labels;
c) The product(s) are complete. All materials accompanying the orders must be returned.

9.2 The User may exercise their right of withdrawal by sending the Withdrawal Model or any other unequivocal statement of contract withdrawal to the email help.outverse@gmail.com.
9.3 The return costs of the order in exercising the right of withdrawal are borne by the customer.
9.4 Upon receipt of the returned product, Out'verse will analyze and confirm the condition of the order and, where applicable, will refund the amounts paid by the User within a maximum period of 15 (fifteen) days, through the same means used for payment of the order.
9.5 If the returned items show signs of use, Out'verse reserves the right not to accept the return and refuse to refund them.
9.6 The User should note that if their return is made for reasons other than the justified existence of defects or non-compliance of the ordered products, OUT'VERSE will not refund the shipping costs. Therefore, OUT'VERSE will not refund the expenses related to the postage initially borne by the customer for the respective order.

10. *CANCELLATIONS AND RETURNS*
10.1 The User may cancel their order, provided that they request it through the email help.outverse@gmail.com before its shipment.
10.2 If the request has been received before shipment, we will refund the amounts paid by the User within the order, through the same means used for payment of the order, within a maximum period of 15 (fifteen) days.
10.3 If the request has been received after shipment, the rules set forth in the previous chapter, regarding the right of withdrawal, will apply.
10.4 Out'verse offers exchanges. The User may also opt for a voucher to exchange their order for another item available on the website, bearing all costs related to the new shipment. Please note that orders placed with a voucher and subsequently returned can only receive a new voucher as a refund and have a validity period of 12 months.

10.5 If the ordered product is found to be defective or otherwise non-compliant, the User may choose to:
a) Replace the product;
b) Terminate the contract.
10.6 As soon as the User notices a defect or other non-compliance with the product, they should notify us via email at help.outverse@gmail.com, providing supporting photographs.
10.7 Upon receipt of your email, we will contact you to resolve the issue amicably.

11. *QUALITY*
11.1 Out'verse does not sell second-hand products, defective products, or products of inferior quality to market standards. The main characteristics of each product shown at www.outversebrand.com are on each product page.
11.2 Out'verse will make every effort to ensure that the colors of the products displayed on the website www.outversebrand.com are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is displaying the exact colors.

12. *LIABILITY*
12.1 Out'verse does not guarantee the uninterrupted operation of the website www.outversebrand.com, which may be suspended for maintenance, repair, or updates.
12.2 Out'verse does not guarantee or accept responsibility for any inconvenience or damage inherent in the use of the internet network, service interruption, external intrusion, presence of computer viruses, or any other force majeure.
12.3 The products will be described and presented on the website www.outversebrand.com as accurately as possible. If errors occur, Out'verse is not responsible. Out'verse is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.

13. *MODIFICATION OF TERMS AND CONDITIONS*
Out'verse reserves the right to change these Terms and Conditions at any time, with changes considered effective and users notified by posting the modified Terms and Conditions on the website www.outversebrand.com.

14. *PERSONAL DATA PROCESSING*
14.1. The information or data provided by users will be processed in accordance with the provisions of the Privacy Policy.
14.2. By using the website www.outversebrand.com, the user consents to the processing of the information and data referred to in the preceding number and declares that all information provided is true and corresponds to reality.
14.3. Personal data will be used by Out'verse for information, disclosure, and order processing purposes.
14.4. The user is guaranteed the right to access, rectify, amend, or delete their personal data, simply by sending an email to help.outverse@gmail.com.

15. *PROOF AND ARCHIVE*
Computer records, kept by Out'verse under secure conditions, are considered proof of communications, orders, and payments made between Out'verse and the User.

16. *INTELLECTUAL PROPERTY*
16.1. All elements, whether sound or visual, of the website www.outversebrand.com, including the underlying technology, are protected by copyright, trademarks, or patents.
16.2. The user who has a personal website and wishes to place, for personal use, a simple direct link to the page www.outversebrand.com on their website must request prior authorization from Out'verse. Authorization is only valid if provided in writing.
16.3. Any link or hypertext directed to the website www.outversebrand.com, using framing or in-line linking techniques, is strictly prohibited.
16.4. In all cases, the use of any link, including those mentioned in the second and third of this document, even if authorized, must be removed upon a simple request to Out'verse.

These Terms and Conditions and all disputes arising from them, including their validity, the use of the website, or any purchases on it, shall be governed by Portuguese law.
